1.Scope

The following general terms and conditions apply to all orders placed via our online shop by consumers and entrepreneurs.By selecting the Terms and Conditions field when you register/booking, you acknowledge the terms and conditions.

A consumer is any natural person who concludes a legal transaction for purposes which cannot be attributed primarily to his commercial or independent professional activity. Entrepreneur is a natural or legal Person or a legal Partnership that acts in The Exercise of its commercial or independent professional Activity when entering into a Legal transaction.

The following applies to entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby objected to; they will only become part of the contract if we have expressly agreed to this.

2.Contractor, conclusion of contract

The purchase agreement is concluded with EloquaMUC language and company courses UG (limited liability), Ottobrunner Str. 15a, 81737 Munich.

The presentation of the products and German courses in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. You can first place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order, using the corrective aids provided for and explained in the order process. By clicking on the order button, you place a binding order for the goods contained in the shopping cart. The confirmation of receipt of your order is made by e-mail immediately after the sending of the order.Places are allocated in the order of entries of the registrations. You will receive a confirmation (in writing or by email) about one week before the start of the event, as to whether the event can be carried out in terms of the number of participants.

To the organization

The provider reserves the right to postpone the date or times or, in case of too few registrations, to cancel an event. In this case, you will be informed by email within a reasonable period of time. All payments already made will be refunded. In addition, there are no further claims.

Withdrawals

You must deregister by phone or in writing and the following fees will be charged:

– up to 30 days before the start of the course – 0% of course f
ees – up to 7 days before the start of the course – 50% of cour
se fees – 6 days or less before the start of the course – 100% of course fees

Cancellation fees are waived if a substitute participant is found. In this case, only administration costs of € 25 will be charged.

Payment arrangements

The participation fees are due immediately, as long as nothing else has been agreed.
Payment can be made online in the booking system.

Companies must pay participation fees within 10 days of invoicing.

In case of multiple registration (one person registers several persons): The sign-up person is liable for the entire participation fees.

Missed parts of an event

Missed parts of an event cannot be made up in principle. In principle, it is also not possible to make pro rata refunds of course costs due to missed parts of an event.

Insurance

The insurance cover during the event is the responsibility of the participant. Any liability is excluded for all events carried out by the provider.

Data protection

By registering, you agree that the provider may use your data (personal data, booked events, etc.) for its own purposes (advertising, information about new offers, etc.). Program and price changes

We reserve the right to make changes to the programme and prices as well as to changes in the General Terms and Conditions. 

When the contract is concluded with us depends on the payment method you choose:

Invoice, SEPA Direct Debit, Stripe, Inc.
We accept your order by sending a declaration of acceptance in separate e-mail or by delivering the goods one week before the course starts.

Prepaym
entWe accept your order by sending a declaration of acceptance in separate e-mail one week before the course starts, in which we give you our bank details.

Credit car
dBy placing your order, you provide your credit card details and the credit card company is conducting an authorization check. Once you have been legitimized as a legitimate cardholder, the payment transaction will be automatically initiated and your credit card will be charged upon placing the order. At the time of credit card charge, the contract with us is concluded.

PayPal
In the ordering process, you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment order to PayPal. After placing the order in the shop, we request PayPal to initiate the payment transaction and thereby accept your offer.

3.Contract language, contract text storage

The languages available for conclusion of the contract are German and English.

We save the contract text and send you the order data and our general terms and conditions in text form. You can view the text of the contract in our customer login.

4.Delivery

All items purchased in addition to the course will be dealt with by the teacher in the course location on the first day of the course.

We only deliver to the instructor by mail order. A self-collection of the goods is unfortunately not possible.

We do not deliver to packing stations.

5.Payment

In our shop, the following payment methods are available to you:

Prepayme
ntIf you select the payment method in advance, we will give you our bank details in separate e-mail and deliver the goods after receipt of payment.

Credit car
dBy placing your order, you provide your credit card details. Once you are legitimized as a legitimate cardholder, the payment transaction will be automatically executed and your card will be charged.

SEPA direct debit proced
ureBy submitting your order, you give us a SEPA direct debit mandate. We will inform you about the date of the account charge (so-called prenotification). By submitting the SEPA direct debit mandate, we invite our bank to initiate the payment transaction. The payment transaction will be carried out automatically and your account will be debited. The account is debited before the goods are shipped. The deadline for prior notification of the date of the account charge (so-called prenotification period) is 1 day.

PayPal
In the ordering process, you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, you must be registered there or register first, legitimize with your access data and confirm the payment order to us. After Placing the Order in The Shop, we ask PayPal to Initiate the Payment Transaction. PayPal automatically carries out the Payment transaction immediately afterwards. ou pay the invoice amount after receipt of the goods and the invoice by bank transfer to our bank account. We reserve the right to offer the purchase on account only after a successful credit check.

6.Withdrawal

Consumers are entitled to the statutory right of withdrawal as described in the cancellation policy. Entrepreneurs are not granted a voluntary right of withdrawal.

7.Warranty and guarantees

Unless expressly agreed otherwise below, the statutory liability for defects shall apply.
When purchasing used goods by consumers, the following applies: if the defect occurs after the expiry of one year from delivery of the goods, the claims for defects are excluded. Defects that occur within one year of delivery of the goods can be claimed within the statutory limitation period of two years from delivery of the goods.
For entrepreneurs, the limitation period for claims for defects in newly manufactured goods is one year from the transfer of risk. The sale of used goods is subject to any warranty. The statutory limitation periods for the right of recourse pursuant to Section 445a of the German Civil Code (BGB) remain unaffected.
As An Agreement to Entrepreneurs on the Nature of the Goods, only our own Information and the Manufacturer's Product Descriptions, which were included in the contract, are considered to be an agreement on the Nature of the goods; We do not Accept any liability for public Statements made by the Manufacturer or other Advertising Statements.
If the delivered item is defective, we guarantee entrepreneurs first at our Discretion by Eliminating the Defect (Rectification) or by Supplying a defect-free item (replacement delivery).

9.Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR), which can be found here. We are not obliged and unwilling to participate in a dispute resolution procedure before a consumer arbitration board.

10.Final provisions

If you are an entrepreneur, German law applies to the exclusion of the UN right to purchase.

If you are a merchant within the meaning of the Commercial Code, a legal entity under public law or a public-law special asset, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our place of business.
